  • Loss & Allowance Reliefs: Carrying forward unabsorbed business losses (up to 10 consecutive assessment years) and capital allowances.

The 5-Step Tax Compliance Workflow

Step 1

Preparation of Finalized Management Accounts

Compile and reconcile your completed balance sheet, profit and loss statement, general ledgers, bank statements, and supporting source invoices into finalized management accounts for the fiscal period.
Step 2

Tax Computation & Capital Allowance Optimization

Our senior tax specialists identify non-deductible items, compute statutory capital allowances, and apply applicable tax exemptions to structure the lowest legal tax liability.
Step 3

Draft Computation & Client Verification

We present an executive tax breakdown highlighting taxable net profit, statutory allowances claimed, and final tax payable for director, partner, or proprietor review.
Step 4

Digital Endorsement & Statutory Clearance

Business owners, designated directors, or compliance officers approve and execute the final returns digitally.
Step 5

Official LHDN Lodgment (Personal or Via Approved Tax Agent)

The return (Form C, Form PT, or Form B) is submitted electronically via LHDN MyTax. Filings can be lodged personally using your company/individual MyTax digital administrator portal, or submitted directly on your behalf by our approved licensed tax agent, generating the official LHDN acknowledgment receipt and billing slip.

Other Occasional & Annual Taxes in Malaysia (Beyond Form C & B)

In addition to core annual income tax returns, Malaysian businesses must actively monitor several periodic and transactional taxes:

Sales & Service Tax (SST — 6% / 8%)

Governed by the Royal Malaysian Customs Department (JKDM). Mandatory registration once taxable services or manufacturing revenue exceeds RM 500,000 (or RM 1,500,000 for F&B operations) over a rolling 12-month period. Bi-monthly returns (Form SST-02) must be filed promptly.

Withholding Tax (WHT)

Applicable when making payments to foreign non-resident individuals or overseas vendors for technical services, management royalties, software licenses, or contract work (typically 10% + 3%). Must be remitted to LHDN within one month of payment to avoid severe penalties and non-deductibility of expenses.

Stamp Duty (Duti Setem)

Levied on official commercial agreements, commercial tenancy leases, loan financing facilities, and share transfers (via LHDN STAMPS portal). Commercial contracts must be officially stamped within 30 days of execution to possess legal evidentiary standing in court.

Real Property Gains Tax (RPGT)

Charged on net chargeable gains derived from the disposal of real properties or shares in Real Property Companies (RPC) in Malaysia. Rates range from 10% to 30% based on company holding tenure.

Monthly Tax Deductions (PCB / MTD) & Statutory Payroll Contributions

Mandatory monthly withholding from employee salaries remitted to LHDN by the 15th of every month, alongside employer/employee EPF, SOCSO, and EIS statutory filings.

Frequently Asked Questions

Clear answers to common questions about incorporating and running your Malaysian business digitally with Zepheus.

Can I withdraw business money anytime, and how is it taxed in an Enterprise vs. a Sdn Bhd / LLP?
In an Enterprise (Sole Proprietor/Partnership), the business and owner are legally the same entity. You can withdraw money ('drawings') at any time without paying extra tax, because you are taxed on the entire business profit under Form B, not on what you withdraw. In contrast, in a Sdn Bhd, company funds belong strictly to the company. Directors and shareholders cannot take money freely for personal use. Funds must be withdrawn as an executive salary (subject to PCB/EPF and deductible for the company) or as declared dividends (tax-exempt to the shareholder under Malaysia's single-tier system).
How long must I keep receipts, bank statements, and invoices for both types of businesses?
Under Section 82 of the Income Tax Act 1967, BOTH Enterprise owners and Sdn Bhd/LLP directors must retain all physical or digitized accounting records, supplier invoices, sales receipts, and bank statements for a statutory period of at least seven (7) years. Failure to produce verifiable source documents during an LHDN tax audit can lead to heavy compounds (RM 300 to RM 10,000) and complete disallowance of claimed expenses.
Does a Sdn Bhd always require an external audit, while an Enterprise and LLP do not?
Yes. An Enterprise and an LLP are 100% exempt from statutory financial audits and submit tax returns purely based on compiled management accounts. For a Sdn Bhd, an annual audit by an approved external auditor is generally mandatory under the Companies Act 2016, unless the company qualifies for SSM audit exemption criteria (such as dormant status, zero revenue, or meeting specific small-company revenue and asset thresholds under RM 300,000 to RM 500,000).
If I buy a vehicle (car) or company laptop, can I deduct the whole cost immediately?
No. Neither an Enterprise nor a Sdn Bhd can write off capital asset purchases as direct day-to-day business expenses in the year of purchase. Instead, you claim 'Capital Allowances' (CA) spread over several years. For example, commercial laptops and office equipment generally receive an initial allowance of 20% plus an annual allowance of 12% to 20%. For passenger motorcars, the maximum claimable cost is capped at RM 50,000 (or RM 100,000 for new non-commercial vehicles under strict price conditions), with restrictions on private vehicle usage.
When does my business need to register for SST, and does choosing an Enterprise vs. Sdn Bhd change the rules?
The SST threshold applies identically to both an Enterprise and a Sdn Bhd. Entity type does not matter. The moment your taxable services or manufacturing revenue exceeds RM 500,000 within a 12-month period (or RM 1.5 million for F&B operators), you are legally required to apply for SST registration with the Royal Malaysian Customs Department within 30 days. Operating as an Enterprise does not exempt you from SST obligations.
